5.2. By placing an order, the Buyer confirms that the information provided is true, complete and up to date.

5.4. The purchase agreement is considered concluded when the Seller has confirmed the Buyer’s order and the Buyer has paid for the order, unless the Parties have separately agreed on another payment or order fulfilment procedure.

5.5. After the order is placed, the Seller sends the Buyer an order confirmation by e-mail or by another communication method specified by the Buyer.

5.6. The Seller has the right to contact the Buyer to clarify order details, availability of goods, delivery, pick-up or payment terms.

5.9. The Buyer agrees to receive invoices, delivery notes, order confirmations and other documents in electronic form at the e-mail address provided by the Buyer. The Seller’s invoices are issued without VAT because the Seller is not a VAT payer.

6. Right to Amend the Terms

6.1. The Seller has the right to amend these terms, including due to changes in legislation, payment terms, delivery terms, product range or the operating procedure of the online store.

6.2. Amendments enter into force from the moment they are published in the online store, unless another effective date is specified in the new version of the terms.

6.3. The version of the terms in force at the time the order is placed applies to the order.

6.4. The Buyer is advised to read the terms before placing each new order.

7. Consumer Right of Withdrawal and Return of Goods

7.1. A Buyer who is a consumer, namely a natural person purchasing goods for purposes not related to economic or professional activity, has the right to exercise the right of withdrawal and withdraw from the distance agreement without giving any reason within 14 calendar days.

7.2. The withdrawal period is calculated as follows:

7.2.1. in the case of the purchase of one item — from the day on which the Buyer or a third party indicated by the Buyer, other than the carrier, has received the goods;

7.2.2. if several goods are ordered in one order and delivered separately — from the day on which the last item is received;

7.2.3. if the goods are delivered in lots or parts — from the day on which the last lot or part is received;

7.2.4. in the case of regular delivery of goods — from the day on which the first item is received.

7.3. To exercise the right of withdrawal, the Buyer must, before the expiry of the 14-day period, send the Seller a clear statement of the decision to withdraw from the agreement. The statement may be sent by e-mail to: rolightlv@gmail.com.

7.4. The Buyer may use the withdrawal form attached to these terms or send a statement in free form.

7.4.1. If the Seller has not provided the Buyer with information about the right of withdrawal and the withdrawal form in the manner prescribed by law, the period for exercising the right of withdrawal may be extended in the cases and manner provided for by the laws of the Republic of Latvia.

7.5. The Buyer must return the goods without undue delay and in any case no later than 14 calendar days from the day on which the Buyer sent the Seller the notice of withdrawal from the agreement.

7.6. The goods must be returned to the following address:

RO-light SIA
Matīsa iela 25, Rīga, LV-1001, Latvia

7.7. The direct costs of returning the goods shall be borne by the Buyer, except where the goods do not conform to the agreement or the Seller has agreed in writing to bear such costs.

7.8. The Seller shall refund all payments received from the Buyer, including the standard initial delivery costs, if such costs were paid by the Buyer, no later than 14 calendar days from the day on which the Seller received the notice of withdrawal.

7.9. The Seller has the right to withhold the refund until the goods have been received back or until the Buyer has provided proof of dispatch of the goods, whichever occurs first.

7.10. If the Buyer selected an initial delivery method that is more expensive than the cheapest standard delivery method offered by the Seller, the Seller is not obliged to reimburse the additional costs related to the choice of the more expensive delivery method.

7.11. The refund shall be made using the same payment method used by the Buyer for the original transaction, unless the Parties agree otherwise. In the case of a bank transfer, the refund shall be made to the bank account specified by the Buyer.

7.12. The Buyer is responsible for any reduction in the value of the goods if the goods have been used more than necessary to determine their nature, characteristics and functioning. The goods must be checked only to the extent that would be possible in a regular store.

7.13. Returned goods must be complete, with original packaging, instructions, warranty documents, labels, protective films, mounting elements, decorative parts and other accessories, if they were provided to the Buyer.

7.14. When returning chandeliers, lighting fixtures and other lighting devices, the Buyer must ensure proper packaging of the goods to avoid damage during transportation. The risk of damage during return delivery is borne by the Buyer until the goods are handed over to the Seller.

7.15. If the goods have been installed, connected, used, damaged, show signs of installation or use, have missing parts, damaged packaging or other signs affecting their value, the Seller has the right to reduce the refund amount proportionally to the reduction in the value of the goods.

7.16. The right of withdrawal does not apply in the cases provided for by the laws of the Republic of Latvia, including where:

7.16.1. the goods have been made according to the Buyer’s individual order or are clearly personalised;

7.16.2. the goods have been made, adapted, modified, assembled or specially ordered according to the Buyer’s individual instructions;

7.16.3. the goods, due to their nature, have been inseparably mixed with other items after delivery;

7.16.4. the goods are not returnable for other reasons provided for by law.

7.17. Goods made or adapted according to an individual order may include, for example, lighting devices of non-standard size, colour or set contents, specially ordered models, goods with individual assembly, goods with modified wiring, mounting, suspension length, decorative elements or other parameters according to the Buyer’s instructions.

7.18. The right of withdrawal does not limit the Buyer’s rights to make claims if the goods do not conform to the agreement.

8. Delivery and Pick-up

8.1. The Seller offers the following methods of receiving goods:

8.1.1. delivery via Omniva parcel machines, if the size, weight and nature of the goods allow such delivery;

8.1.2. pick-up from the Seller’s store/office/warehouse at: Matīsa iela 25, Rīga, LV-1001, Latvia;

8.1.3. another delivery method, if separately agreed by the Parties.

8.2. The possibility of delivery via Omniva parcel machines depends on the dimensions, weight, fragility and packaging of the goods. Large, heavy or fragile chandeliers and lighting fixtures may not be suitable for delivery to a parcel machine.

8.3. The delivery fee is indicated when placing the order or agreed separately with the Buyer.

8.4. The Buyer must provide accurate and complete delivery information, including name, surname, phone number, e-mail address and the selected Omniva parcel machine.

8.5. The Seller is not responsible for delivery delays or inability to deliver if the Buyer has provided incorrect or incomplete information.

8.6. After the goods are handed over to the carrier, the Buyer may be sent shipment tracking information, if such a service is provided by the carrier.

8.7. Upon receipt of the goods, the Buyer must check the condition of the packaging. If the packaging is damaged, the Buyer must record the damage, take photographs where possible and notify the Seller immediately.

8.8. If the goods are received via a parcel machine, the Buyer must check the packaging and goods as soon as possible after receipt. If damage is found, the Buyer must immediately notify the Seller and keep the packaging, documents and photographs of the damage.

8.9. In the case of pick-up, the Buyer must agree with the Seller on the date and time of receiving the goods.

8.10. In the case of pick-up, the goods are considered delivered to the Buyer at the moment when they are actually handed over to the Buyer or the Buyer’s representative.

8.11. If the Buyer does not collect the goods within the agreed period, the Seller has the right to contact the Buyer to agree on a new collection period. If the Buyer unjustifiably does not collect the goods and does not respond to the Seller’s messages, the Seller has the right to cancel the order and refund the amount paid, deducting actually incurred costs, if such deduction is permitted by law.

8.12. The risk of accidental loss or damage to the goods passes to the Buyer from the moment the goods are received by the Buyer or by a third party indicated by the Buyer, other than the carrier. If the Buyer independently chooses a carrier not offered by the Seller, the risk passes to the Buyer from the moment the goods are handed over to such carrier.

9. Price of Goods and Delivery Costs

9.1. The price of the goods is indicated in the online store next to the relevant goods.

9.2. The Seller is not a VAT payer; therefore, prices in the online store are indicated without charging VAT. VAT is not itemised in the Seller’s invoices.

9.3. The price of the goods does not include the delivery fee, unless expressly stated otherwise in the online store.

9.4. The delivery fee is indicated separately when placing the order or agreed with the Buyer before the order is confirmed.

9.5. The Seller makes reasonable efforts to ensure that prices are correct; however, technical errors may occur in the online store. If the price of the goods is indicated incorrectly, the Seller has the right to cancel the order and offer the Buyer to place a new order at the correct price.

9.6. A change in the price of the goods after conclusion of the agreement does not affect an already confirmed and paid order, except in cases of an obvious technical error or cases provided for by law.

12. Manufacturer’s Warranty

12.2. The term and conditions of the manufacturer’s warranty are indicated in the warranty documents, instructions, product description or manufacturer’s documentation.

12.3. The manufacturer’s warranty does not limit the consumer’s statutory rights provided for by the laws of the Republic of Latvia.

12.4. The warranty does not apply where the defect has arisen due to:

12.4.1. incorrect installation or connection;

12.4.2. use of the goods other than for their intended purpose;

12.4.3. failure to follow the manufacturer’s instructions;

12.4.4. mechanical damage;

12.4.5. exposure to moisture, overheating, voltage fluctuations or other external influences, if the goods are not intended for such conditions;

13.1.6. review the Buyer’s applications, notices and complaints in accordance with the procedure established by law.

14.5. If the non-conformity of the goods with the agreement is confirmed, the Seller shall act in accordance with applicable law, including repair, replacement, price reduction or refund, if provided for by law.

14.6. The Seller is not responsible for defects that arise after the goods have been handed over to the Buyer as a result of incorrect storage, installation, connection, use, mechanical damage, external influence, unauthorised repair or modification of the product structure.

14.7. Before installing a lighting device, the Buyer must inspect the goods. Installation of goods with visible damage or non-conformities may affect the possibility of receiving a full refund if the installation has caused a reduction in the value of the goods.

15. Liability of the Parties

15.1. The Parties are liable for non-performance or improper performance of their obligations in accordance with the laws of the Republic of Latvia.

15.2. The Seller is not liable for losses incurred by the Buyer due to incorrect choice of goods, if the Seller has provided information about the characteristics of the goods.
